The Edward Palonek Scholarship Giveaway Official Rules


NO PURCHASE NECESSARY. Participation requires Internet access.

WHO CAN PARTICIPATE. To participate in the Edward Palonek Scholarship (the “Scholarship”) you must:

    •         Be a full time or part time student of an accredited college, university or trade school in the United States.

    •         Be a legal resident of the 50 United States or the District of Columbia, including APO/FPO addresses excluding Puerto Rico.

•     Be eighteen (18) years of age or older as of the date of submission of application.


CONTEST PERIOD. The Edward Palonek Scholarship will be accepting entries online only. Entries will be accepted starting at or about January 9, 2011 and ending at 11:59:59 PM (EST) January 22, 2011.  The next Scholarship, entries will be accepted on January 23, 2011 and ending at 11:59:59 PM (EST) April 30, 2011. Thereafter, entries will be accepted from the 1st of each 3 month period and ending at the end of the 3 month period (“Draw Period”). Proof that you entered your form and submission does not constitute proof or evidence that an entry was actually received within the Draw Period. Participants assume all risk of lost, late, misdirected, incomplete or illegible entries. All entries submitted become the sole property of the Sponsor and will not be acknowledged or returned. The Sponsor reserves the right and at its sole discretion to stop or suspend the Scholarship Giveaway at any time and for any period of time.

HOW TO ENTER. One entry per person.  You may enter only online. Entries are limited to one per person during each drawing period. Submitting an entry constitutes agreeing to the terms of these Official Rules and all decisions of Sponsor and/or its designee, which are final and binding in all respects. Sponsor is not responsible for incorrect, inaccurate or incomplete entry of information or for entries which are garbled, damaged, incompletely received, otherwise defective or lost due to any reason, all of which will be voided.  Each submission of an Entry Form and an Entry Piece shall constitute an entry (“Entry”). Entrants may not enter with multiple emails and/or multiple identities nor use any automated entry mechanism or artifice to obtain more than the maximum number of entries. Any entrant who attempts to participate with multiple emails and/or multiple identities or uses any device or artifice to obtain more than the maximum number of entries will be disqualified.

ENTRY REQUIREMENTS. Entry Form requires: full name, age, phone number, address, e-mail address, School name and expected graduation date, how you found out about the scholarship, and any other requested information listed and agreement to the Rules.

Any language appearing on the Entry Piece must be in English. Entry Pieces must be tasteful. Language will be evaluated by Sponsor based on context and societal acceptability. Content must be intended for a family audience and must, in the sole and unfettered discretion of the Sponsor, be suitable for a general audience and must not contain any nudity, sexually explicit, disparaging, libelous or other inappropriate content. Entry Piece must not contain any commercial content that promotes any product or service other than the Sponsor’s. Entry Piece must not contain any trademarks, copyrighted works or other intellectual property (other than as owned by the Entrant). Any elements appearing in an Entry Piece, must be the Entrant’s own original work, created solely by the Entrant. Use of anything that is not the Entrant’s own original work, may result in disqualification. Sponsor reserves the right to reject any Entry that it deems, in its sole discretion, to violate any of these content related requirements. If the content of the Entry Piece does not meet the requirements listed above, the Entry Piece will not be posted for viewing.

CONDITIONS APPLICABLE TO ALL ENTRIES. By submitting an entry (or accepting a Scholarship), each Entrant understands and agrees that their Entry Piece and name may be posted online and on sites such as Facebook as well as another site(s) and form(s), as Sponsor desires, in Sponsor’s sole discretion, without compensation or review, and will not be returned. Sponsor reserves the right to crop any entry in whole or in part or request submitters to do so, in order to be viewable online. Entrant further agrees to release Sponsor from any and all claims that any such use by Sponsor, including any commercial advertising presentation, web content or any other material subsequently produced, presented and/or prepared by or on behalf of Sponsor, infringes the Entrant’s rights with regard to any elements, characters or ideas contained in its Entry.

WHAT CAN BE WON. One (1) Scholarship of $250 for each Draw Period. Payment will be made directly to each winner of the Scholarship. Entrant must provide Sponsor with the identity of the educational institution and proof of enrollment. Winners are responsible for the reporting and payment of all federal, state and local taxes incurred by the acceptance of the Scholarship. Scholarships cannot be assigned, transferred, exchanged or otherwise redeemed. Sponsor is not responsible for any costs associated with accepting or otherwise using the Scholarship. Acceptance of Scholarship constitutes permission to the Sponsor and its agents to use Scholarship’s winner's name, likeness, and entry piece for purposes of advertising and trade without compensation, unless prohibited by law.

HOW TO WIN. Attempts to contact the potential Scholarship winners will be done by email or such other means as Sponsor my implement. Exact means of contact is at the Sponsor’s sole discretion. If a potential Scholarship winner is unable to be reached or refuses to accept the Scholarship, the potential Scholarship winner will be disqualified and an alternate winner may be selected. Each potential Scholarship winner must submit a photo graph suitable for posting on websites and, must sign and return any and all documents that the Sponsor requires the Scholarship winner to execute (“Scholarship Documents”). Sponsor shall have no liability or responsibility to award any Scholarship where: (a) any required Scholarship Documents are not fully executed and received by Sponsor; or (b) if any email addressed to the potential Scholarship winner is returned to Sponsor as undeliverable or if potential Scholarship winner cannot be contacted for any reason; (c) potential Scholarship winner is deemed ineligible or otherwise non-compliant with any aspect of these Official Rules. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY SCHOLARSHIP WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH INDIVIDUALS DISQUALIFICATION AS A WINNER AND ALL PRIVILEGES DUE SUCH INDIVIDUAL WILL BE IMMEDIATELY TERMINATED AND AN ALTERNATE SCHOLARSHIP WINNER WILL BE SELECTED. (d) The Sponsor also reserves the right to disqualify a Scholarship winner at any time at Sponsor’s sole discretion. Potential winners may be subject to a background check, which must be satisfactory in Sponsor's absolute discretion. In the event the potential Scholarship winner is ineligible to participate based upon the information contained in the background check, an alternate winner will be selected.

IDEA SUBMISSION. These type of competitions generate substantially similar submissions or entries which closely resemble concepts and ideas that have been independently developed by Sponsor or other entrants before or after the Scholarship Giveaway. Accordingly, as a condition of Scholarship Giveaway entry, each Entrant acknowledges and agrees that (a) Sponsor and other participants have access to and/or may create or have created media or other materials, ideas and concepts which may be similar or identical to the Entrant’s Scholarship Giveaway Entry in theme, idea, plot, format, characters and/or other respects; (b) Entrant shall not be entitled to any compensation or other consideration because of the use by Sponsor or any other participant of any such similar or identical material, ideas and/or concepts; and (c) Sponsor’s or another participant’s use of material containing elements similar to or identical with those contained in the Entrant’s Scholarship Entry shall not obligate Sponsor to negotiate with nor entitle the Entrant to any compensation or other claim.

CONDUCT. By entering this Scholarship giveaway, each Entrant agrees to be bound by these Official Rules and by the decisions of the Sponsor and its judges and agents, which are final and binding in all matters relating to the Scholarship giveaway. Sponsor reserves the right at its sole discretion to disqualify and prohibit any Entrant from participating in the Scholarship giveaway or winning a Scholarship who Sponsor suspects, in its sole discretion, of attempting to undermine the legitimate operation of the Scholarship giveaway by cheating, hacking, deception, or other unfair playing practices (including the use of automatic quick entry programs) or intending to annoy, abuse or threaten or harass any of the Sponsors' representatives or otherwise failing to comply with these Rules or for any other reason. NOTE: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER PERSON TO DAMAGE ANY WEB SITE ASSOCIATED WITH THE SPONSOR OR ITS AGENTS OR UNDERMINING THE LEGITIMATE OPERATION OF THE SCHOLARSHIP IS A VIOLATION OF CRIMINAL AND CIVIL LAW, AND SPONSOR AND ITS AGENTS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.


RELEASE OF LIABILITY. Each Scholarship winner, by acceptance of the Scholarship, agrees on behalf of him/herself, his/her heirs, executors, representatives, assigns, administrators and next of kin to indemnify, hold harmless and release the Sponsor, its parent, subsidiary and affiliated businesses and each of their officers, directors, shareholders, employees, advisors, assignees, agents, representatives and any other person or entity associated with this Scholarship giveaway from any and all liability claims or actions of any kind with respect to or in any way arising from this Scholarship giveaway, participation in any Scholarship giveaway-related activity; and/or delivery/mis-delivery, acceptance, possession, use, or misuse of a Scholarship, including, but not limited to, liability for personal injury, bodily injury (including wrongful death or disability), damage to property, and damage or loss of any other kind. Sponsor is not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or used in the Scholarship giveaway or by any technical or human error that might occur in the processing of Scholarship Entries. Sponsor assumes no responsibility for any error; omission; interruption; deletion; defect; delay in operation or transmission; communications-line failure; or theft, destruction, unauthorized access to, or alteration of Entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines; computer online systems, servers, or providers; computer equipment; software; or failure of e-mail or entry on account of technical problems or traffic congestion on the Internet or at any Web site or combination thereof, including injury or damage to participant's or to any person's computer related to or resulting from participating in this Scholarship giveaway, downloading materials from Sponsor’s Web site or emailing entries. Sponsor is not responsible for cheating or fraud by any participant. Any activities intended to disrupt or interfere with Scholarship giveaway or defraud Sponsor in any way will be prosecuted to the fullest extent of the law. Participants who engage in any of the foregoing activities will be disqualified and will forfeit any Scholarship giveaway won. If, for any reason, the Scholarship giveaway is not capable of running as planned, due to, without limitation, infection by computer virus, worm, or bugs; tampering; unauthorized intervention; fraud; technical failures; or any other causes beyond the control of Sponsor that, in the sole opinion of Sponsor, could corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Scholarship giveaway, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Scholarship giveaway at any time. Sponsor is not responsible for any typographical or other error in the printing of these Official Rules or any materials associated with the administration of the Scholarship giveaway or the announcement of the Scholarship giveaway. In all events, the sole maximum liability of Sponsor and its affiliates shall be limited to any of the Scholarship giveaway set forth herein.

PRIVACY. Information Entrants provide to Sponsor will be used to communicate with Entrants regarding this Scholarship giveaway and otherwise as set forth in these Official Rules, as well as to contact Entrants at a later date with respect to other products and services and product enhancements which the Sponsor believes may be of interest to them. By submitting an entry on-line to Sponsor, all Entrants acknowledge and agree that the personal information that they have provided will be maintained by Sponsor.

PUBLICITY CONSENT. By submitting an entry or accepting a Scholarship giveaway, where permitted by law, each Scholarship winner grants to Sponsor (and agrees to confirm that grant in writing, if deemed desirable by Sponsor) and those acting pursuant to the authority of Sponsor, the irrevocable right without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter developed, including, but not limited to, the World Wide Web, in perpetuity and throughout the universe, his/her Entry, including, without limitation, the entry and Scholarship winner's name, portrait, picture, voice, likeness, image or statements about the Scholarship giveaway, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.

WINNER'S IDENTITY & OFFICIAL RULES. Scholarship giveaway winners' name, state of residence and Entry Piece, will be posted on the Sponsor's web site and any other site or form at Sponsor’s discretion.

SPONSOR. Farallon Tropical, S.A. sponsors this Scholarship giveaway. Sponsor reserves the right to cancel the Scholarship giveaway at any time or to suspend it for any period of time.

MISCELANEOUS. Entrant's must have a mailing address in the United States of America. The school the Entrant is attending must have offices and a mailing address in the United States of America. (Funds will not be disbursed outside of the United States.)

   Entries will only be accepted when submitted through our online entry form. Mailed, faxed, or emailed applications will not be read, considered, acknowledged, or returned.

   Entrant’s should not mail us transcripts or other information unless they have been contacted by us and the information has been specifically requested. Unsolicited information will be discarded.

   All information and essays submitted become the property of the Sponsor and may be used to advertise the Edward Palonek Scholarship Award, or in any other endeavor Sponsor desires.

   You will not be allowed to change or edit information once your entry has been submitted. (This includes contact information).

   If you think your contact information will change before the Scholarship award is given, you may want to wait before submitting your entry.

   Make sure everything is accurate and complete before clicking on the "Submit” button.

   We cannot manually confirm the receipt of any particular entry. Your only confirmation will be the confirmation screen you see at the end of the application.

   It is your responsibility to ensure you receive email from the Sponsor. We are not responsible for email dropped by your ISP, flagged as junk mail, lost in transit, etc.

   As a student, we expect you to use correct spelling, grammar, punctuation, and sentence case. Your essay should be fun and interesting. Make us want to read your essay.

   Note: We highly recommended you first write your essay with a text editor or word processor, check it for accuracy, and then return to the scholarship application page to submit your essay. You can simply copy and paste your essay into the appropriate area. If you type your essay on the online application and lose it don't whine to us.
